Medicaid Changes

Dear Resident/Family Member:

This is to advise you that there have been important changes in the New York State Medicaid bed hold and therapeutic leave regulations. In the past, each time a Medicaid recipient was hospitalized, the facility was obligated to hold their bed for a maximum of 20 days under the bed hold regulations. In addition, if a resident was out of the facility on a therapeutic leave, the Home was able to use reasonable judgment in justifying the leave, with no definitive maximum number of allowable days.

Effective July 19, 2010, these regulations have changed. If a resident is hospitalized they will now be entitled to a maximum of 14 bed hold days in any 12 month period of time, regardless of the number of hospitalizations. In addition, therapeutic leave days have been limited to 10 days per 12 month period of time. In the event that either the bed hold or therapeutic leave days exceeds the allowable days, as established by New York State regulations, the Home will be obligated to discharge the resident unless they choose to pay to hold the bed. In such cases, the bed can be held if the resident, or representative, make arrangements through the Resident Services Coordinator to pay for the bed. Such arrangements can me made in advance and must be accompanied by a signed Resident Paid Bed Hold Form. If the resident/family declines this option, they will have the right to the first available appropriate semi-private room once he/she is ready to return to the Home.
